很多人甚至是企業(yè)，對競業(yè)限制（competitive restriction）存在誤解，認(rèn)為簽訂《保密協(xié)議》（NDA，Non Disclosure Agreement）就能簽訂《競業(yè)限制協(xié)議》，不論職位高低，一律簽訂《競業(yè)限制協(xié)議》。

但根據(jù)我國《勞動合同法》相關(guān)條例規(guī)定，競業(yè)限制的人員（Personnel subject tothe restriction of competition）限于用人單位的高級管理人員（senior executives）、高級技術(shù)人員（senior technical）和其他負(fù)有保密義務(wù)的人員（personnel under theobligation of confidentiality），如財會人員、秘書等。

常見的限制有社交距離限制（social distancing restriction）、旅行限制（travel restriction）、貿(mào)易限制（trade restriction。）
