第八條 外事活動(dòng)和國(guó)家駐外使館、領(lǐng)館以及其他外交代表機(jī)構(gòu)對(duì)外使用國(guó)徽?qǐng)D案的辦法,由外交部規(guī)定,報(bào)國(guó)務(wù)院批準(zhǔn)后施行。
Article 8 Measures for the use of the design of the National Emblem in activities of foreign affairs and by the country’s embassies, consulates and other diplomatic missions stationed in other countries shall be prescribed by the Ministry of Foreign Affairs and submitted to the State Council for approval before implementation.

第九條 在本法規(guī)定的范圍以外需要懸掛國(guó)微或者使用國(guó)徽?qǐng)D案的,由全國(guó)人民代表大會(huì)常務(wù)委員會(huì)辦公廳或者國(guó)務(wù)院辦公廳會(huì)同有關(guān)主管部門(mén)規(guī)定。
Article 9 Where the hanging of the National Emblem or the use of the design of the National Emblem is necessitated outside the scope specified in this Law, it shall be prescribed by the General Office of the Standing Committee of the National People’s Congress or the General Office of the State Council, in conjunction with the departments concerned.

第十條 國(guó)徽及其圖案不得用于:
Article 10 The National Emblem and the design thereof shall not be used in:

(一)商標(biāo)、廣告;
(1) Trademarks or advertisements;

(二)日常生活的陳設(shè)布置;
(2) Furnishings or ornaments in everyday life;

(三)私人慶吊活動(dòng);
(3) Private activities of celebration or condolence; and

(四)國(guó)務(wù)院辦公廳規(guī)定不得使用國(guó)徽及其圖案的其他場(chǎng)合。
(4) Other circumstances where the National Emblem and the design thereof may not be used, as prescribed by the General Office of the State Council.

第十一條 不得懸掛破損、污損或者不合規(guī)格的國(guó)徽。
Article 11 No damaged, defiled, or substandard National Emblem shall be hung.

第十二條 懸掛的國(guó)徽由國(guó)家指定的企業(yè)統(tǒng)一制作,其直徑的通用尺度為下列三種:
Article 12 The National Emblem to be hung shall be uniformly made by enterprises designated by the State and the diameters of its usual dimensions shall be as follows:

(一)一百厘米;
(1) One hundred centimetres;

(二)八十厘米;
(2) Eighty centimetres; and

(三)六十厘米。
(3) Sixty centimetres.

在特定場(chǎng)所需要懸掛非通用尺度國(guó)徽的,報(bào)國(guó)務(wù)院辦公廳批準(zhǔn)。
The hanging, in special places, of the National Emblem in unusual dimensions shall be subject to the prior approval of the General Office of the State Council.

第十三條 在公眾場(chǎng)合故意以焚燒、毀損、涂劃、玷污、踐踏等方式侮辱中華人民共和國(guó)國(guó)徽的,依法追究刑事責(zé)任;
Article 13 Whoever desecrates the National Emblem of the People’s Republic of China by publicly and wilfully burning, mutilating, scrawling on, defiling, or trampling upon it shall be investigated for criminal responsibility according to law;

情節(jié)較輕的,參照治安管理處罰條例的處罰規(guī)定,由公安機(jī)關(guān)處以十五日以下拘留。
If the circumstances are relatively minor, the offender shall, with reference to the provisions of the Regulations on Administrative Penalties for Public Security, be punished by the public security organ with a detention of not more than fifteen days.

第十四條 縣級(jí)以上各級(jí)人民政府對(duì)國(guó)徽的使用,實(shí)施監(jiān)督管理。
Article 14 The people’s governments at or above the county level shall exercise supervision and control over the use of the National Emblem.

第十五條 本法自1991年10月1日起施行。
Article 15 This Law shall enter into force as of October 1, 1991.

Appendix I: THE DESIGN OF THE NATIONAL EMBLEM OF THE PEOPLE’S REPUBLIC OF CHINA

說(shuō)明:國(guó)徽的內(nèi)容為國(guó)旗、天安門(mén)、齒輪和麥稻穗。象征中國(guó)人民自“五四”運(yùn)動(dòng)以來(lái)的新民主主義革命斗爭(zhēng)和工人階級(jí)領(lǐng)導(dǎo)的以工農(nóng)聯(lián)盟為基礎(chǔ)的人民民主專(zhuān)政的新中國(guó)的誕生。
Caption: Comprising the National Flag, Tian’anmen, a cogwheel and ears of wheat and rice, the National Emblem symbolizes the new-democratic revolutionary struggle waged by the Chinese people since the May 4th Movement in 1919, as well as the birth of the New China under the people’s democratic dictatorship led by the working class and based on the alliance of workers and peasants.
