Law of the People’s Republic of China on the National Emblem
(1991年3月2日第七屆全國(guó)人民代表大會(huì)常務(wù)委員會(huì)第十八次會(huì)議通過1991年3月2日中華人民共和國(guó)主席令第四十一號(hào)公布自1991年10月1日起施行)
(Adopted at the 18th Meeting of the Standing Committee of the Seventh National People’s Congress on March 2, 1991, promulgated by Order No. 41 of the President of the People’s Republic of China on March 2, 1991, and effective as of October 1, 1991)
第一條 為了維護(hù)國(guó)徽的尊嚴(yán),正確使用國(guó)徽,根據(jù)憲法,制定本法。
Article 1 This Law is enacted, in accordance with the Constitution, with a view to upholding the dignity of the National Emblem and ensuring the correct use of the National Emblem.
第二條 中華人民共和國(guó)國(guó)徽,中間是五星照耀下的天安門,周圍是谷穗和齒輪。
Article 2 The National Emblem of the People’s Republic of China shall comprise the design of Tian’ anmen in its centre illuminated by five stars and encircled by ears of grain and a cogwheel.
中華人民共和國(guó)國(guó)徽按照1950年中央人民政府委員會(huì)通過的《中華人民共和國(guó)國(guó)徽?qǐng)D案》和中央人民政府委員會(huì)辦公廳公布的《中華人民共和國(guó)國(guó)徽?qǐng)D案制作說(shuō)明》制作。
The National Emblem of the People’s Republic of China shall be made in accordance with the Design of the National Emblem of the People’s Republic of China adopted by the Central People’s Government Council in 1950, and the Directions for the Making of the Design of the National Emblem of the People’s Republic of China promulgated by the General Office of the Central People’s Government Council in the same year.
第三條 中華人民共和國(guó)國(guó)徽是中華人民共和國(guó)的象征和標(biāo)志。
Article 3 The National Emblem of the People’s Republic of China is the symbol and hallmark of the People’s Republic of China.
一切組織和公民,都應(yīng)當(dāng)尊重和愛護(hù)國(guó)徽。
All organizations and citizens shall respect and care for the National Emblem.
第四條 下列機(jī)構(gòu)應(yīng)當(dāng)懸掛國(guó)徽:
Article 4 The following organs shall hang the National Emblem:
(一)縣級(jí)以上各級(jí)人民代表大會(huì)常務(wù)委員會(huì);
(1) The standing committees of the people’s congresses at or above the county level;
(二)縣級(jí)以上各級(jí)人民政府;
(2) The people’s governments at or above the county level;
(三)中央軍事委員會(huì);
(3) The Central Military Commission;
(四)各級(jí)人民法院和專門人民法院;
(4) The people’s courts at various levels and the special people’s courts;
(五)各級(jí)人民檢察院和專門人民檢察院;
(5) The people’s procuratorates at various levels and the special people’s procuratorates;
(六)外交部;
(6) The Ministry of Foreign Affairs; and
(七)國(guó)家駐外使館、領(lǐng)館和其他外交代表機(jī)構(gòu)。
(7) The country’s embassies, consulates and other diplomatic missions stationed in other countries.
鄉(xiāng)、民族鄉(xiāng)、鎮(zhèn)的人民政府可以懸掛國(guó)徽,具體辦法由省、自治區(qū)、直轄市的人民政府根據(jù)實(shí)際情況規(guī)定。
The people’s governments of townships, nationality townships and towns may hang the National Emblem, specific measures for which shall be stipulated by the people’s governments of provinces, autonomous regions and municipalities directly under the Central Government in light of their actual conditions.
國(guó)徽應(yīng)當(dāng)懸掛在機(jī)關(guān)正門上方正中處。
The National Emblem shall be hung right in the middle on top of the front gate of the organ concerned.
